Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Singapore Manufacturing Federation website at www.smfederation.org.sg, including any SMF-operated webpages, online services or restricted-access areas that expressly refer to these Terms (collectively, the “Website”). 

The Website is operated by the Singapore Manufacturing Federation (“SMF”, “we”, “us” or “our”). 

By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, please do not use the Website. 

Scope of these Terms

These Terms apply to your use of the Website and the content, information, resources and functions made available through it. 

Certain SMF services, programmes, memberships, events, applications, registrations, transactions or restricted-access services may be subject to separate or additional terms and conditions. 

Where specific terms apply to a service, programme, event, application or transaction, those specific terms will apply in addition to these Terms. If there is any inconsistency, the specific terms will take precedence in relation to that service, programme, event, application or transaction. 

Websites operated by SMF’s related organisations, service providers, partners or other third parties may have their own terms and are not governed by these Terms unless expressly stated. 

Changes to these Terms and the Website

SMF may amend these Terms from time to time. Any revised Terms will be posted on this page together with the date of the latest update. 

Your continued use of the Website after revised Terms have been posted constitutes your acceptance of those revised Terms. 

SMF may also update, modify, suspend, withdraw or discontinue any part of the Website, its content or its functions at any time. 

Permitted Use 

You may access and use the Website for lawful purposes, including obtaining information about SMF, its activities, membership, programmes, events, services, industry initiatives and resources. 

Unless otherwise stated, you may download or print reasonable extracts of publicly available SMF content for your own personal or internal business use, provided that you do not modify the content, remove any copyright or proprietary notices, or represent the material as your own. 

Any other reproduction, publication, commercial distribution or use requires SMF’s prior written permission unless permitted by applicable law. 

Intellectual Property

Unless otherwise stated, all rights in the Website and its contents, including text, reports, publications, data compilations, graphics, photographs, videos, audio, designs, software, trademarks, logos and other materials, are owned by, licensed to or otherwise used with permission by SMF. 

Nothing in these Terms transfers any intellectual property rights to you. 

Materials owned by third parties remain subject to the rights and conditions imposed by their respective owners. 

Where SMF expressly provides different terms for a particular publication, report, dataset, image, video or other resource, those terms will apply to that material. 

SMF Name, Logo and Marks 

The Singapore Manufacturing Federation name, SMF name, SMF logo and other SMF marks may not be used without SMF’s prior written permission, except where such use has been expressly authorised by SMF. 

You must not use SMF’s name, logo or other marks in a manner that suggests SMF has endorsed, certified, sponsored, approved or entered into a partnership with you, your organisation, product or service unless SMF has expressly authorised you to do so. 

Separate brand or logo-use requirements may apply to SMF members, partners, sponsors, award recipients, programme participants and other authorised parties. 

Acceptable Use

You must not use the Website in any manner that is unlawful, fraudulent, harmful or that interferes with the operation, security or use of the Website by others. 

In particular, you must not attempt to gain unauthorised access to the Website, another user’s account, SMF systems or connected networks; introduce viruses, malware or other harmful code; bypass security or access controls; impersonate another person or organisation; submit false, misleading, defamatory, infringing or unlawful material; harvest personal or contact information without authorisation; send unsolicited commercial communications through the Website; or interfere with the Website’s normal operation. 

You must not systematically scrape, crawl, extract, copy, harvest or download Website content or data using automated means, or compile Website content into databases or datasets, without SMF’s prior written permission, except for ordinary search-engine indexing carried out in accordance with SMF’s technical instructions or where otherwise permitted by law. 

You must not use SMF content or data obtained from the Website to develop or train artificial intelligence or machine-learning systems on a systematic basis without SMF’s prior written permission, except where such use is expressly authorised by SMF or permitted by applicable law. 

Accounts and Restricted-Access Services

Some parts of the Website may require registration or an account. 

If you create or use an account, you are responsible for providing accurate and current information and for keeping your login credentials confidential. 

You are responsible for activity carried out through your account unless the activity results from circumstances for which you are not responsible. 

You must notify SMF promptly if you know or reasonably suspect that your account or login credentials have been compromised or used without authorisation. 

If you use the Website on behalf of an organisation, you represent that you are authorised to act on behalf of that organisation for the relevant purpose. 

SMF may suspend or restrict access to an account or restricted service where reasonably necessary to protect users, SMF, its systems or third parties, or where these Terms or applicable service terms have been breached. 

Information Submitted Through the Website

You remain responsible for information, documents and other materials that you submit to SMF through the Website. 

By submitting material, you confirm that you have the authority and necessary rights to provide it and that its submission and use for the stated purpose will not infringe the rights of another person. 

Unless different terms are stated for a particular service, application, programme or submission, you retain ownership of intellectual property rights in material that you submit. 

You grant SMF a non-exclusive, royalty-free licence to store, copy, process, reproduce, adapt and use the submitted material only to the extent reasonably necessary to administer your request, application, registration or participation, provide the relevant service, operate the Website, or carry out another purpose communicated to you when the material is submitted. 

Where you submit material for publication, promotion, media use or public display, additional permissions or programme-specific terms may apply. 

Do not submit confidential, commercially sensitive or proprietary information through general enquiry forms unless SMF has expressly requested the information or provided an appropriate channel for its submission. 

Personal data submitted through the Website will be handled in accordance with SMF’s Privacy Statement and applicable data protection requirements. 

Registrations, Applications, Memberships and Transactions

The Website may enable users to enquire about, register for, apply for or make payment in relation to SMF membership, events, programmes, services or other activities. 

Such activities may be subject to additional terms covering matters such as eligibility, fees, payment, cancellation, refunds, attendance, application requirements or participation. 

Submitting an application or registration does not in itself guarantee acceptance, approval, funding, certification, membership, participation or any other outcome unless SMF expressly states otherwise. 

Where SMF uses a third-party platform, payment processor or service provider to support a transaction or service, use of that third-party service may also be subject to the provider’s own terms and privacy practices. 

Information and Professional Advice

SMF seeks to provide useful and relevant information to manufacturers, members and other stakeholders. However, content on the Website is provided for general information purposes unless expressly stated otherwise. 

Website content may include information concerning government policies, regulations, grants, schemes, standards, international trade, markets, workforce matters, sustainability, technology, business practices or other subjects that may change over time. 

SMF does not warrant that all Website content will at all times be complete, current, accurate or suitable for a particular purpose. 

Website content should not be treated as legal, financial, tax, regulatory, technical, investment, human resources or other professional advice. 

Where a decision depends on current legislation, regulation, government requirements, eligibility criteria or other third-party information, users should check the relevant original or official source and obtain appropriate professional advice where necessary. 

Nothing in this section limits any obligations expressly undertaken by SMF under a separate written agreement for professional or advisory services. 

Third-Party Content, Members,Partnersand Links 

The Website may contain content supplied by third parties or links to websites, platforms, services, publications or resources operated by third parties. 

SMF does not control those third parties and is not responsible for their websites, services, content, security, availability or privacy practices. 

A reference or link to a third party does not by itself constitute an endorsement or recommendation by SMF. 

Similarly, the inclusion or profiling of an SMF member, partner, sponsor, speaker, exhibitor, service provider, product or organisation on the Website does not by itself mean that SMF endorses or guarantees that organisation, person, product or service. 

You should make your own assessment before entering into a transaction or business relationship with a third party. 

Linking to the SMF Website

You may link to publicly available pages on the Website provided that the link is lawful, accurate and does not suggest any endorsement, sponsorship, partnership or association with SMF that does not exist. 

You must not frame the Website within another website or use the SMF logo as a link without prior written approval. 

SMF reserves the right to request removal of any link that is misleading, unlawful, damaging to SMF’s reputation or otherwise inconsistent with these Terms. 

Website Availability and Security

SMF takes reasonable steps to maintain the Website but does not guarantee that the Website, its functions or its content will always be available, uninterrupted, secure or free from errors, viruses or other harmful components. 

Access may be interrupted for maintenance, upgrades, technical issues, security reasons or circumstances outside SMF’s reasonable control. 

You are responsible for maintaining appropriate security measures, backups and protection for your own systems, devices and data when accessing the Website.

SMF’s collection, use, disclosure and handling of personal data through the Website is governed by SMF’s Privacy Statement.

Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis. 

SMF does not make any express or implied warranty regarding the Website’s availability, accuracy, completeness, reliability, security or suitability for a particular purpose. 

To the fullest extent permitted by law, SMF and its officers, employees and representatives will not be liable for indirect, incidental, special or consequential loss or damage arising from or in connection with your access to, use of, inability to use, or reliance on the Website or its content. 

This includes, to the fullest extent permitted by law, loss of profits, business, revenue, opportunity, goodwill or data. 

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Singapore law. 

Any liability arising from a separate SMF service, programme, event, membership or contractual arrangement will be governed by the terms applicable to that arrangement. 

Suspension or Termination of Access

SMF may restrict, suspend or terminate your access to all or part of the Website where SMF reasonably considers this necessary because of a breach of these Terms, unlawful activity, security risk, misuse of the Website or protection of SMF’s or another person’s rights. 

Any provisions which by their nature are intended to survive termination or cessation of use will continue to apply. 

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. 

Any dispute arising out of or in connection with these Terms or the use of the Website shall be subject to the jurisdiction of the courts of Singapore. 

General

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect. 

A failure or delay by SMF to exercise any right under these Terms does not constitute a waiver of that right. 

These Terms, together with any applicable specific terms referred to in them, constitute the terms governing your use of the Website.
